Cambodia’s specific geographical location and long history and complicated topographical, ecological and social features has resulted in it becoming a prosperous, rich and diverse plant genetic resource country. While diverse climatic conditions diversified the country’s flora with both tropical and temperate plants, thousands of years of agricultural practice by ethnic groups enriched its crop genetic resources with large numbers of local cultivars and land races. In terms of medicinal plants, the high level of genetic diversity makes Cambodia an attractive country for bio-prospecting, especially given that there are approximately 800 known medicinal plants, many of which have associated traditional knowledge. However, Cambodia faces a wide range of issues that threaten its biological diversity and ecological security. These threats emanate from the transition from a subsistence-based agrarian economy to a consumption-based cash economy, competing land use from urbanization and infrastructure development, poaching of wild plants and animals, localized overharvesting of timber, fuel wood and non-wood forest products, human-wildlife conflicts, and climate change. Because of the threat to biological resources, the traditional knowledge of local communities that is associated with genetic resources is disappearing rapidly, due to the change of traditional lifestyles. A large volume of traditional knowledge, such as medicinal use of biological resources, is being replaced by modern technology. The National Biodiversity Strategy and Action Plan (NBSAP) of Cambodia was adopted in 2002. The NBSAP identified equity as the most important thing biological resources sustainably in the long run and calls for consideration of poor and economically disadvantage group to secure their access to common resources.

To counter the various threats to biodiversity, the country has planned various strategies for the conservation and sustainable use of biological resources for socio-economic development.

Scope of Work and objectives

Under the overall guidance and supervision of the National Project Director (PD), the selected national consultant will work closely with Project Coordinator (PC), UNDP Programme Analyst, MoE and relevant institutions/stakeholders to complete the assignments.

Institutional Arrangement

The Consultant will be performed under the supervision of the Project Director. The consultant will liaise on a day-to-day issue with PMU, UNDP Programme Analyst and MoE for ABS project in Cambodia. S/he will also work closely with the relevant institutions, development partners and academic/research institutions to ensure full cooperation and collaboration from all stakeholders.

Duration of the Work

The assignment is expected to be performed between from March to June 2022. It is expected that the final documents will be submitted by the 1st week of June 2022.

Duty Station

The duty station of this assignment is a combination of home-based and/or be based in Ministry of Environment in Phnom Penh. If any travel to the provinces for stakeholder consultations, the Daily Substantive Allowance (DSA) and transportation will be covered by the project and will be arranged by PMU.

Duties & Responsibilities:
  • Tasks and responsibilities of the national consultant include but are not limited to:
  • Develop framework for monitoring and tracking GR application, utilization and commercialization processes:
  • Based on the developed national ABS legislation and its processes, review and identify user’s obligations before and after the genetic resources and associated traditional knowledge has been accessed for all aspects;
  • Review national/international best practices and identify appropriate mechanisms to support the compliance (including national-level databases on traditional knowledge, access permits and ABS agreements) and to track and monitor genetic resources in the patent system; and
  • Develop framework for monitoring and tracking GR’s application, utilization and commercialization processes, including guideline development to enhance capacity and facilitate its implementation in order to ensure the compliance monitoring and the Nagoya Protocol;
  • Based on A above, review and develop monitoring and evaluation (M&E) plan to unsure regular update, including results framework baselines, theory of change to subsequently adopt these findings to implement all aspects of the project;
  • Participate and present in the consultation meetings and workshops;
  • Consolidate the comments, recommendations and feedback from stakeholders’ consultation meeting and workshop(s);
  • Assist project management unit (PMU) to prepare national consultation workshop and ABS Sub-TWG meeting for further inputs and recommendations;
  • Compile reports about the finding and documentation;
  • Submit the final documents and all related references to project management unit (PMU) and UNDP for reviewing and project director (PD) for approval; and
  • Other tasks may require.
Requirements:
  • Minimum Qualifications of the Individual Contractor
  • Education:
  • At least Master’s degree of Biodiversity and Natural Resource Management and Conservation and/or Environmental and Resources Science, Ecosystem Services, M&E plan development and/or related field.
  • Experience:
  • Proven experience in ABS procedure, framework and policy development in both user and provider countries– at least 5 years;
  • Prior experience in biodiversity and resources assessment and monitoring, NRM or specific to ABS including research and development, knowledge on Nagoya Protocol, particularly ABS-related issues and M&E plan;
  • Proven experience in the management of projects including familiarity with logical frameworks, SMART indicators and strategic planning. ABS projects will be an asset. Knowledge about UNDP Programming cycle, applied rules and regulation is an asset; and
  • Proven experience in evaluation and monitoring project implementation and its result findings.

  • Tasks and responsibilities of the National Consultant include but are not limited to:
  • Develop guideline and procedures for addressing issues related to ABS agreement:
  • Identify issues related to ABS procedures for users and providers of genetic resources and associated traditional knowledge and business and private sectors for industries such as the pharmaceutical, biotechnology, agriculture, crop protection, cosmetics, and food/beverage that use genetic resources;
  • Identify target stakeholders for improving their capacity to process ABS access applications, negotiating ABS agreements, applying PIC and MAT procedures, facilitating access to genetic resources, compliance monitoring and monitoring bio-prospecting projects, development of certificate of origin and PIC certificate; and Develop guidelines and procedures for addressing and facilitating ABS agreements which compliance to the Nagoya Protocol and National Legislation;
  • Develop three training tools/models, including it supporting materials for capacity development related to the implementation of National ABS Legislation inline with the Nagoya Protocol, and as well as the valuable of genetic resources and associated traditional knowledge to relevant institution and related stakeholders;
  • Prepare an action plan for ABS capacity building to key stakeholders and agencies on ABS administrative and permitting system and monitoring and enforcement of ABS agreement:
  • Review and identify topics and tools/models, target stakeholders and timeframe for providing capacity building; and
  • Develop training action-plan, including the concept note and content;
  • Provide training to NCA, FP and target stakeholders on:
  • The provisions of the Nagoya Protocol, including ABS procedure and PIC and MAT requirements; and
  • The development and use of model ABS agreements based on the Nagoya Protocol and National Legislation;
  • Participate and present in the consultation meetings and workshops;
  • Consolidate the comments, recommendations and feedback from stakeholders’ consultation meeting and workshop(s);
  • Assist project management unit (PMU) to prepare national consultation meetings and workshops for further inputs and recommendations;
  • Compile reports about the finding and documentation;
  • Submit the final documents and all related references to project management unit (PMU) and UNDP for reviewing and project director (PD) for approval; and
  • Other tasks may require.
Requirements:
  • Education:
  • At least Master or PhD (is preferable) degree in Law, Environmental Policy and Natural Resources Management and Development, and as well as the relevant fields such as ABS legislation development, genetic and resources science and ecosystem services.
  • Experience:
  • Prior experience in developing and providing capacity development related to ABS and Environmental, and as well as natural resources and biodiversity management and conservation – at least 5 years;
  • Proven experience in ABS procedure, contract development and negotiation process for access and utilization of genetic resources and associated traditional knowledge both user and provider countries which compliance to the Nagoya Protocol;
  • Proven experience in producing tool and education materials to enhance the capacity development to all different stakeholders at national and sub-national levels.
  • Experience working with a wide variety of development actors in Cambodia including with the Royal Government of Cambodia, international development organizations, private sector entities, and/or civil society organizations including community groups.
  • Competencies:
  • Strong analytical skills and ability in developing and teaching Legislation, Policy and Frameworks;
  • Excellent analytical capacity and ability to synthesize project outputs and relevant findings for the preparation of quality project reports;
  • Ability to understand ABS terminology analysis/synthesize information from different sources into a coherent project log-frame and framework;
  • Skill in achieving results through persuading, influencing and working with others;
  • Ability to understand Cambodia’s context and communication;
  • Maturity and confidence in dealing with senior members of international, regional and national institutions;
  • Displays sensitivity and adaptability to different cultures, genders, religions, races, nationalities and age groups;
  • Good team player, self-starter, has ability to work under minim supervision and maintain good relationships.
  • Language:
  • Fluency in Khmer and English required;
